He or she actually gives you credit on the site. Your name is stated as original from: Not sure it makes you feel any better, but at least he/she is not trying to claim ownership of the image.

This info about the author was added after the complaints were made!
This still doesn't allow him to use any imge, without prior authorization.

I just wish I was capable of taking pics that someone WANTED to steal! It is a sort of backhanded compliment, I suppose!
Oh well! (sigh and pray for getting in the 5s with shoes entry!)

Not that I condone what he has done. Certainly he should have asked permission first. But he does have a disclaimer on the right giving credit to the photog by name.

I do not know where the site is hosted. Or what country it is. But remember, not all nations subscribe to our stringent copyrights. And in many cases such use is allowed so long as credit is given.
Japan for instance protects names but often you can clone imagery. Which is why Japan has so many toy clones that are near direct knock-offs of some icon.
So it may very well be legal for him to post once he has sited the work. Whether such is right or wrong is another debate entirely. |

In any case it violates what is stated clearly at the bottom of each page on dpc -- "All digital photo copyrights belong to the photographers and may not be used without permission." Shouldn't that be grounds for banning the person from dpc, or at least suspending the account?

Most definitely, DPC is within the right according to their terms of use to terminate membership. (Sadly, if they're unpaid they'll just create a new one.)

Actually, the site is hosted by a company based in Portugal. You know, that little country sharing the Iberian peninsula with Spain, on the western end of Europe...
And no, our copyright laws DO NOT allow that kind of abuse. |

Latest Update:
The admins have removed his portfolio again.
I have opened an account there and uploaded the image entitled 'The REAL Three in One macro'
He will at least have to find somewhere else to upload that particular image, though I'm sure he will be out stealing someone elses images to fill his portfolio.
