Here is my problem; I have taken photos for various different clients (mainly interior photography) and I am a little unclear on whether I can use some of them in my online porfolio (i am currently just finishing it up). Do I have to ask permission? Can I just put the shot on the site aslong as I mention who they where for? What do i need to know?

They own the rights. Start putting a clause in your agreement to allow promotional use by you. Ask for permission for the ones you've already done. |

Whether they own the right or you do depends on the nature of your contractual agreement with them, whether written or verbally agreed-to.
Basically, if you work as an independent contractor, then you have the copyright (with possible limitations on their use), but if it is considered a "work for hire" then the client owns the copyrights.
I strongly suggest you do some reading at the US Copyright Office, and/or order some books on the subject from [url=//nolo.com[/url] before you commit to any further action. |

I only do the photography on the side, I am a graphic/web designer by trade, so all the work I do is verbal. In fact usally I am just contracted out by other companies to take the photos for them, so I guess I am like a 3rd party photographer. Also are there differences in the copyright laws between Canada and the US... I live in Canada.

The laws are likely to be substantially the same, but this may be a case where they could differ. Perhaps you can find (and post!) a link to the Canadian equivalent to the Copyright Office; they are very likely to have similar basic info on Canadian law there. |
